Dr Stephan Gerstner


Born in Erlangen in 1965. Studied law in Freiburg im Breisgau and Geneva, Switzerland. 1991 first State examination, 1995 second State examination. Research assistant at the Institute for Public Law, University of Freiburg im Breisgau, 1991–1994. 1994 doctoral degree with Prof Dr Wahl, Freiburg im Breisgau. Since 1996 lawyer in Berlin.

Joined the firm in 2001.


Regulatory and sector‐related antitrust law (postal, railway and energy law), in particular open network provision and price regulation, energy law, in particular renewable energy, competition (general antitrust and merger control), public price control, EU law.

Member of the German antitrust law association.

Providing comprehensive legal advice to Deutsche Post AG on pricing and price approvals by the German Federal Network Agency (Bundesnetzagentur), and acting as legal counsel for it in proceedings.

Conducting lawsuits before the German Constitutional Court over the protection of company and trade secrets

Providing comprehensive legal advice to and acting as counsel for the infrastructure operator of Deutsche Bahn group on issues relating to pricing and network access.

Acting as counsel for a transmission network operator in a landmark action over system safety

Advising an energy supplier on pilot offshore wind power projects
